Terms of Service

These Terms of Service ("Terms") govern your use of the KachaSilver mobile application and associated services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally competent to enter into contracts under Indian law.
You must be a resident of India and provide accurate identification (Aadhar, phone, email) during registration.
One person may operate only one active account. Duplicate accounts may be suspended without notice.

2. Nature of the Service

KachaSilver is a peer-to-peer marketplace that connects buyers and sellers of physical silver. We provide price references (including MCX-derived rates), listing tools, messaging, and a transaction log.

KachaSilver is not a dealer, broker, custodian, assayer, or financial advisor.
All transactions are executed off-platform, directly between buyer and seller. KachaSilver does not hold, transport, verify, or guarantee any silver or payment.
Price suggestions and MCX rates shown in the app are indicative only and may be delayed or inaccurate. Always verify before transacting.
Compliance with applicable tax laws, including GST, on transactions executed through or initiated by the Service is solely the responsibility of the respective buyer and seller. KachaSilver does not collect, remit, or advise on any taxes arising from peer-to-peer transactions.

3. Account Responsibilities

You are responsible for all activity under your account. Keep your login credentials confidential.
You must provide accurate profile information and keep it updated.
Notify us immediately of any unauthorized access at kachasilverx@gmail.com.

4. Listing Rules

When creating a listing, you represent and warrant that:

You own or have the legal right to sell the silver listed.
Stated weight, purity, location, and price are accurate to the best of your knowledge.
The silver is not stolen, pledged, encumbered, or subject to any legal restriction.
You will not list the same silver on multiple platforms with the intent to mislead.

5. Prohibited Conduct

You agree not to:

Post false, misleading, or fraudulent listings.
Impersonate any person, business, or entity.
Harass, threaten, or abuse other users.
Manipulate prices, create fake demand, or coordinate with other users to distort the market.
Attempt to circumvent the Service's security, rate limits, reporting system, or moderation.
Use the Service for money laundering, tax evasion, or any unlawful purpose.
Scrape, reverse-engineer, or resell data from the Service without written permission.

6. Reporting and Moderation

Every listing and user profile in the Service can be reported using the flag icon. Reports are reviewed by us, and we may take any of the following actions at our sole discretion: warn, remove content, suspend, or permanently terminate an account. We are not obligated to disclose moderation decisions or their reasoning.

7. No Warranty

The Service is provided "as is" without warranty of any kind, express or implied. We do not warrant:

Accuracy or timeliness of price data, MCX rates, or any suggestions.
Availability, quality, or legitimacy of any listing, buyer, or seller.
That transactions initiated on the Service will be completed successfully.
That the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, KachaSilver and its operator shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of silver, money, data, profits, or business arising out of or in connection with your use of the Service. Our aggregate liability for any claim shall not exceed INR 1,000 or the amount you have paid us in the preceding 12 months (whichever is greater).

9. Dispute Between Users

Any dispute between a buyer and seller — including non-delivery, payment failure, quality disputes, or fraud — is a matter between those parties. KachaSilver may, but is not required to, assist by providing transaction logs. You release KachaSilver from any claim arising from such disputes.

10. Suspension and Termination

We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, posed a risk to other users, or engaged in fraudulent or illegal activity. You may delete your account at any time from the app's profile settings; some data may be retained for legal, audit, or anti-fraud purposes.

11. Changes to the Terms

We may modify these Terms from time to time. Material changes will be announced in the app or via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu.
